Sounds very familiar to (BP) Little's testimony:
Little told the panel he didn’t know why Guide failed to make sure the blowout preventer was inspected and overhauled by its owner, Transocean.
and Guide never gave any answer why he did not insist on checking to replace the almost dead battery
BP discovered in a September 2009 audit of the rig that the blowout preventer was years overdue for maintenance, according to documents entered into evidence.
and Transocean never gave any answer why they renegaded on their responsibility to carry out regular maintenance on their key CRITICAL FAIL-SAFE equipment. Yet they can congratulate themselves with fat bonuses and declare their best performance in Safety.

If BP (Guide) had insisted on a simple Check Equipment Functionality (standard operating procedure) before deployment of any undersea equipment especially one that cannot be retrieved any time soon, they would have DISCOVERED an almost dead battery and would have replaced it (or they would not because it would spoil their plans).
Your guess is as good as mine, how 3 different companies (including DNV) stretching from Sept 2009 till April 2011 and top managers / professionals can give equally mind-baffling answers to the same problem.

Transocean witnesses who were scheduled to testify today have refused to show up and could not be compelled to do so because they live out of the area, where the federal subpoenas served against them from New Orleans have no power
What did they do? Ship these guys to Mexico, so they couldn't be forced to dream up yet another cock and bull story?
